The family of Vineswaran, a 26-year-old Malaysian Indian man, says he was arrested on suspicion of drug use on 3 May, remanded after a urine test allegedly returned positive, and sent to Penjara Kuala Kubu Bharu when his family could not raise the RM3,000 bail.
On Monday (20 July) at 2.34 pm, his father received a call saying his son was in critical condition.
Four minutes later, a woman identifying herself as a doctor called to say Vineswaran was dead.
He had been healthy when he entered custody; he left in a body bag.
The case was raised publicly by former minister and lawyer Waytha Moorthy Ponnusamy, who described the father — a 53-year-old man he estimated looked closer to 65 — as “the face of Malaysia’s forgotten poor.”
Poverty, Waytha wrote, had aged him far beyond his years and now it had taken his son.
This Is Not A New Story, It Is A Recurring One
Malaysia recorded 42 custodial deaths in 2025 alone, according to Home Minister Datuk Seri Saifuddin Nasution Ismail.
Between 2001 and 2021, rights group Suaram documented at least 124 custodial deaths by name — and noted those were only the cases they could confirm.
Research has consistently shown Malaysian Indians are overrepresented among custodial death victims relative to their share of the population.
SUHAKAM, the national human rights commission, has repeatedly stated that every individual holds a fundamental right to life under Article 5 of the Federal Constitution — and that custodial deaths must be independently investigated.
The investigations, when they happen, frequently conclude with natural causes, suicide, or drug overdose.
Waytha Has A Name For The pattern: “Brotherhood In Uniform”
Waytha does not call it corruption, exactly.
He calls it a culture — of silence, mutual protection, and institutional self-preservation where honest officers, he argues, become prisoners of the system, and those who abuse power find comfort in knowing the institution will close ranks around them.
He cited three cases to illustrate the point:

“This Is Not About Race, It Is About A System”
Prime Minister Datuk Seri Anwar Ibrahim accused Waytha of making inflammatory claims that Hindus are unable to practice their religion in Malaysia and are being murdered while in police custody.
Waytha, who is also president of the Malaysian Advancement Party (MAP), says that is a distortion.
This is not about race. It is not about religion. It is about a system.
The reframe matters.
When a systemic critique becomes a racial debate, the conversation shifts — from institutions to identity, from accountability to sensitivity, and the original question gets lost in the noise.
Waytha is saying, on the record, that this is exactly what is happening; the question Waytha ends with carries no question mark.
Will the death of Vineswaran be another file closed and forgotten.
