He also said that the case is being investigated under:

  • Regulation 9 and Regulation 10 of the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas) (Recovery Movement Control) 2021 (PU (A) 293) Regulations
  • Section 21A of the Prevention and Control of Infectious Diseases Act 1988 (Act 342) Section 269 of the Penal Code (Act 574)
  • Section 9 (5) of the Peaceful Assembly Act

The police has also noted that the Dewan Rakyat Secretary issued a notice to MPs on 30 July that the Special Sitting has been postponed to a later date.

Acryl said this is based on the risk assessment done by the Health Ministry (MOH) and also suggestions from the Director-General.

Police knew Opposition MPs were coming to Parliament

He mentioned that the police received information on 1 August that a gathering would take place at the Parliament compound on 2 August.

Taking into consideration that on that date, no Parliament sitting would take place as it had been postponed and there were no reasons for the MPs to be at the Parliament, the police took necessary measures to prevent any gathering from being held.

This move, he said, was in line with provisions under Regulation 9 and Regulation 10 of the Prevention and Control of Infectious Diseases (Measures within the Local Infected Areas) (National Recovery Plan) (NRP) Regulations 2021, dated 4 July, which states that gatherings and processions are banned throughout the NRP.

Opposition MPs recently gathered at Dataran Merdeka after they were denied entry into Parliament.
