Police Hunts For Man Who Allegedly Raped A 15YO, Suhakam Criticises Teen Mum’s Detention Condition

The suspect is believed to be the teen girl’s boyfriend who has fled to the northern part of Terengganu.

A 15-year-old girl in Kemaman, Terengganu, has been detained by the police after her newborn baby was found dead with stab wounds to the chest on Tuesday, 8 February.

The girl dropped out of school soon after the movement control order (MCO) was implemented. Her parents did not know she was pregnant because she was missing from home.

She’s believed to be a rape victim, and the police are hunting down a suspect who’s her 20-year-old boyfriend named Mohammad Hazuarie Hassan.

The police have asked Mohammad Hazuarie to surrender to assist in the investigation, but he has not done so.

The police could not find him at his house in Bandar Seri Bandi, and it’s believed that he has fled to the northern part of Terengganu.

Kemaman district police chief superintendent Hanyan Ramlan asked the public to come forward if they have any information about the suspect.

Criticisms about detention condition of teen mum

Meanwhile, there have been criticisms about the detention conditions of the teen mother. The 15-year-old girl has been remanded and detained in a police lock-up since 9 February.

Suhakam children’s commissioner Noor Aziah Mohd Awal said detaining the 15-year-old girl who had just given birth and is in some trauma is clearly not in the child’s best interests.

We are of the view that the approach taken in dealing with a child who is in conflict with the law should be in line with the Convention on the Right of the Child (CRC) to which Malaysia is a party. Suhakam believes that the girl is definitely suffering from a horrible mental health condition that led her to act in such a way.

Suhakam children’s commissioner Noor Aziah Mohd Awal said in a statement.

As reported by Malaysiakini, she added that the teenager should receive the proper postpartum treatment, including psychological therapy, before going through the prosecution process.

The girl should be given the necessary legal aid, in particular, the right to a legal representative (lawyer) as well as a social welfare officer who would act as her probation officer and protector.

The Social Welfare Department is also urged to arrange for the legal aid to be provided to the girl on a pro bono basis.

Noor Aziah said under Section 83A of Act 611, the teen arrested should not be handcuffed and her parents or guardian must be informed of the child’s whereabouts.

The child’s identity should be protected and not disclosed under the same Act and the CRC.

Furthermore, children in detention should not be placed with an adult who has been charged with an offence.
