For slapping a foreign labourer, a 30-year-old was slapped with a RM5,000 fine after the latter pleaded guilty to the offence.
Mohd Risamuddin Ab Wahab was charged at the Magistrate’s Court here under Section 325 of the Penal Code for voluntarily causing grievous hurt to Bangladeshi Shaheb Ali on Oct 17 around 12.45pm at the Master Clean Car Care in Taman Subang Perdana, Subang.
The offence carries a maximum jail sentence of up to seven years or a fine upon conviction.
Magistrate Ellyana Razali then ordered the accused to pay the sum, which would then be paid to the victim and the car wash owner, Haziyati Abdul Hamid, 36.
The procedure was done in accordance with Section 260 of the Criminal Procedure Code (CPC).
As the case was settled in court today, the magistrate also set other conditions for both the victims and the accused.
Apart from paying the RM5,000 amount and apologising to both Shaheb and Haziyati, the magistrate said both the accused and Shaheb were not allowed to make any statement to the media and both parties could not initiate any other form of legal suit pertaining to the matter.
In the courtroom today, Mohd Risamuddin apologised and shook hands with the duo.
Last Saturday, the accused was caught on a CCTV footage uploaded by the car wash owner, in which he was seen slapping the foreign car wash worker repeatedly after the latter emerged from the driver’s seat of the SUV holding a wash cloth.
It was widely reported that Mohd Risamuddin refused to pay for the car wash service and even demanded a compensation of RM1,000, accusing the Bangladeshi of dirtying his SUV with the wash cloth.
