Suasa Airlines Sdn Bhd was fined RM380,000 by the sessions court here yesterday for operating without a valid Air Service Permit (ASP).
Judge Harith Sham Mohamed Yasin handed down the sentence on Suasa Airlines after a company representative pleaded guilty to carrying passengers for hire or reward on a non-scheduled journey between Kuala Lumpur and Langkawi without a valid ASP.
The offence was committed in July last year at the Sultan Abdul Aziz Shah Airport, Subang, Selangor under Section 36 of the Malaysian Aviation Commission Act 2015. The company paid the fine.
Prosecution was conducted by Mohamad Abazafree Mohd Abbas, head of the General Crimes and Public Order Unit, and deputy public prosecutor Afzainizam Abdul Aziz.
Malaysian Aviation Commission (MavCom) executive chairman Tan Sri Abdullah Ahmad said in a statement all matters relating to the issuance, suspension and revocation of an Air Service Licence (ASL) and ASP came under the purview of MavCom since its inception on March 1 last year.
He said airlines which did not possess a valid ASL or ASP were not allowed to undertake any commercial air service operations in Malaysia.
He said an entity is required to have both or an ASL or ASP issued by MavCom and an Air Operator Certificate (AOC) issued by the Department of Civil Aviation Malaysia.
Abdullah said MavCom had rejected on 22 July 2016 Suasa Airlines’ application to operate a non-scheduled commercial flight from Kuala Lumpur to Langkawi as it did not possess a valid ASP.
However, on the same day, Suasa Airlines operated the flight as a ‘demonstration flight’ and following that, MavCom launched a thorough investigation and brought up the matter to the Attorney-General’s Chambers.
“MavCom would like to emphasise the importance of complying with the laws and regulations which is a basic requirement for participation in this industry.
“Airline companies must have all the approvals from the authorities, prior to any operation, as required not only by Malaysian law but also in accordance with international standards and practices.
“The stringent steps taken by the commission are to protect consumers and therefore, MavCom will take action against offenders who do not comply with the laws and regulations of the industry.”
